Tinkuq Terms of Use
Kipu Quantum GmbH · Version: 19 October 2026
1. Scope
1.1 These Terms of Use govern your use of Tinkuq, the AI matchmaking agent provided by Kipu Quantum GmbH, Greifswalder Str. 212, 10405 Berlin, Germany, registered with the Local Court of Charlottenburg under HRB 287200 (“Kipu”, “we”).
1.2 Tinkuq is free of charge and requires no registration. By using Tinkuq, you accept these Terms of Use.
1.3 Tinkuq is intended for business users only.
1.4 These Terms of Use do not govern the Kipu Quantum Hub. Use of the Hub is subject to its own terms.
2. The service
2.1 Tinkuq helps you describe a business problem and suggests possible quantum computing approaches. Its answers and Assessment reports (“Outputs”) are generated automatically by an AI system that uses AI models of third-party providers.
2.2 Outputs may be incorrect, incomplete or outdated. They are non-binding and are neither advice nor an offer. Please verify Outputs before relying on them. A binding offer requires a separate agreement with Kipu.
2.3 Tinkuq is provided “as is” and “as available”. We may change, restrict or discontinue Tinkuq at any time.
3. Your inputs
3.1 Do not enter into Tinkuq:
- confidential information or trade secrets,
- personal data,
- content you are not entitled to share, or
- technical data subject to export control.
3.2 You are responsible for your inputs. You grant Kipu the right to process your inputs to the extent necessary to operate Tinkuq.
4. Acceptable use
4.1 You must not:
- use Tinkuq for unlawful purposes,
- try to circumvent its safeguards or manipulate it, for example by prompt injection or by extracting its instructions,
- access Tinkuq by automated means such as bots or scrapers, or overload it,
- use Tinkuq or its Outputs to develop a competing service or to train AI models, or
- use Tinkuq if you are subject to EU, German or US sanctions.
4.2 We may block access to Tinkuq if you breach these Terms of Use.
5. Outputs
5.1 You may use Outputs, including Assessment reports, for your own business purposes and share them within your organization.
5.2 Outputs are marked as AI-generated. You must not remove this marking or present Outputs as a binding statement of Kipu.
5.3 Kipu gives no warranty that Outputs are free from third-party rights.
6. Liability
6.1 Kipu is liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and under any guarantee given by Kipu.
6.2 As Tinkuq is provided free of charge, Kipu’s liability is otherwise excluded.
7. Privacy
Our Privacy Policy (https://kipu-quantum.com/privacy) explains how we process data when you use Tinkuq.
8. Changes
We may amend these Terms of Use with effect for future use. The version published at the time of your use applies.
9. Governing law and jurisdiction
9.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory laws of your country of residence.
9.2 If you are a merchant, a legal entity under public law or have no general place of jurisdiction in Germany, the exclusive place of jurisdiction is Berlin, Germany.
